I had heard that if a crime is not declared it can make your insurance invalid, yesterday evening I was shocked when I phoned my current Building and Contents provider MORE TH>N, explained the situation, asked if they would continue to insure me after I have been to court, and was told that they were going to terminate my policies immediatly. - "Whilst accounts of discrimination by some major Insurers against ex-offenders continue to appear in forums and the position of the Insurance industry in general still seems some way from adopting universal, unambiguous, consistent and non-discriminatory policy in this, thought some might find it useful to hear a positive account of one who only recently (through UNLOCK) became aware of the risks of “passive” non-disclosure. This is in the context of Motor Insurance and a single non-motoring conviction seven years ago for which I served 9 months of an 18 month sentence. My former Motor Insurance had been routinely renewed annually since prior to this conviction and I had had no claims or motoring convictions for over nine years. As the only specific questions asked by my former insurers at renewals concerned such claims or motoring convictions, I had not been asked for nor thought to advise any non-motoring conviction. Only after reading the UNLOCK guidance on this did I search for (and find amongst the small print of the policy wording) any reference to disclosure of “any other material fact". Anyway, I found myself needing a new policy – and urgently. I scanned the list published by UNLOCK, visited some of their websites and submitted online quotation requests to a few of these including SIS; now, of course, including details of my non-motoring conviction.
- "SIS were the first to respond – later the same day by phone (options for ways to communicate were offered during initial online quote request). A very pleasant and helpful lady guided me through my request including the conviction and suggested a policy from AXA would probably be most suitable. To my surprise the price of this was actually LOWER than that which I had been paying previously and the excesses were also markedly lower! I agreed there and then, paid the premium by debit card and the proposal form including details of my conviction, temporary cover note and other details arrived in the post just 24 hours later. I signed and returned the proposal form - but then found on one of the AXA online pages reference to their policy of NOT providing insurance products to anyone with a non-motoring conviction. When I received the Certificate and Schedule of Insurance from SIS a couple of days later, I could find no reference to the conviction I had disclosed – which sent me slightly into paranoid mode once again. In the event of claim, how was I to prove I had, in fact, disclosed! I emailed the same lady who had initially arranged this AXA insurance requesting such confirmation based on advice by Christopher Stacey elsewhere in this forum:
“The learning point from this is to always ensure that written confirmation is obtained (from the broker would be sufficient) of the information that has been disclosed.”
"After three days I had heard nothing so I sent another email restating my need for confirmation and a few other details. This time, within a couple of hours, I received an email from David Child, Director of SIS, confirming disclosure had been recorded and accepted by AXA. To this was attached a copy of the proposal form which I had signed and returned and which included detail of my non-motoring conviction. Not sure why AXA would say one thing online and do the opposite in reality. Maybe they have recently changed their policy or maybe they will accept applications from non-motoring ex-offenders; but only through agencies or brokers such as SIS who may enjoy a “priviledged relationship” with them. In any event, thanks to UNLOCK and SIS I can now, at least, rest assured I now have valid motor insurance.
"Obviously, each application will be dealt with based on the unique individual circumstances of the applicant, but the morals of the story are:
- Always disclose non-motoring convictions; whether specifically asked for or not
- Always ensure written confirmation of disclosure is obtained
- Always take and retain copy of proposal forms and any relevant correspondence
- Trust the work of UNLOCK in researching and compiling the list of insurance agents/brokers
